MobyNet Privacy Policy
The privacy of each end user accessing or using our Site and Software (as defined below) (each end user, “you”) is important to MobyNet Corp. (“MobyNet”, “we,” “us”). Therefore, MobyNet is committed to respecting your privacy and the confidentiality of your personal data, traffic data, and communications content.
We’ve developed this Privacy Policy to tell you how we collect, use, disclose, transfer, and store your information. This Privacy Policy is designed to assist you in understanding how MobyNet uses and safeguards the information you provide in using MobyNet’s peer-to-peer communications software and applications, a well as MobyNet's websites, including the site at www.MobyNet.io (the “Site”), and/or other MobyNet products and/or services (collectively, the “MobyNet Software and/or MobyNet Services”).
Please review this Privacy Policy (the “Policy”) to familiarize yourself with our privacy practices. Your use of the MobyNet Software, including accessing or browsing the Site, means that you have read and agree to the terms of this Policy. If you do not want your information used or collected as described below, please leave the Site immediately and do not access or use our software. Finally, this Policy is also incorporated into the MobyNet End User License Agreement (“EULA”) which, if you choose to download our software, you will need to review and agree to be bound by.
In addition to this Privacy Policy, we provide data and privacy information embedded in our products and certain features that ask to use your personal data. This product-specific information when introduced will be accompanied by our Data & Privacy Icon. You will be given an opportunity to review this product-specific information before using these features. You also can view this information at any time, either in settings related to those features and/or online at https://MobyNet.io You can familiarize yourself with our privacy practices, accessible via the headings below, and contact us if you have any questions.
Our Privacy-First Architecture
MobyNet and its applications represent a privacy-first approach to human communications.
First, MobyNet’s mission is to directly connect you and your devices to others in your network under your control, and as such the MobyNet represents a new multi-protocol software overlay Internet for applications that bypass the central clouds, blockchains, and ultimately DNS and even ICANN. MobyNet is by design, a self-sovereign People’s Internet, that each user creates with the software on their own devices using the resources of the devices they own, the Internet connection service they have provisioned, and the power they supply to charge. MobyNet hands the keys to the Internet and your privacy to you which comes with you taking back responsibility for your own data as we did in the personal computer era prior to the Web.
You are in effect your own service provider of your on piece of the MobyNet that Moby users create with their own resources. When you deploy your instance of the MobyNet on your devices. Moby gives you your own piece of the global MobyNet. Applications on the MobyNet simply directly connect you to others operating MobyNet and the MobyMail application suite software so you can communicate directly and safely with self-custody of your own communications and profile data. The MobyNet is not a platform with corporate control of your email history, it is a multi-protocol networking tool on your device that enables you to bypass but interoperate with cloud and blockchain services. That said if you are an employee of a business subscriber you agree to share your secure back-up key with your employer as it is a requirement that groups like this must be able to read and retain the communications of the group.
MobyNet is decentralized to the level of every device, more decentralized than blockchain solutions and capable of Internet-scale delivery of the 70 trillion emails and petabytes of social sharing without a federated or cloud server infrastructure, and treats existing resources in the cloud and blockchains as endpoints to integrate both web2 and web3 solutions around you. MobyNet and its MobyMail native reference productivity application suite enable you to store your communications and profile data local first, and to steadily repatriate information you have shared out to cloud and blockchain services under your own control.
In this sense MobyNet and its applications represent a new personal local first approach to computing and communications. The philosophy extends to the use of endpoint AI that is intended to work for you and help you with your data under your ownership, and control, including the private encryption keys to access your data which are also under your control.
What this means is MobyNet and the native MobyMail suite of applications operating on the MobyNet represent a paradigm shift that is a bit back to the future wherein you are in control of your own data on your own devices and in control of the connections you directly create with colleagues and participating companies. Integrating or using MobyNet and Moby applications with cloud services and blockchains comes with acceptance of the privacy policies and risks of such integrations or use.
Moby does not for example place information you repatriate from an existing cloud service onto your own device into a Moby corporate cloud but instead facilitates private cloud and distributed storage solutions that are also subject to access that requires your own encryption private keys. As such MobyNet neither stores your communications history or the keys to your encryption. By design, MobyNet, Corp., the Company, does not possess a trove of centrally stored data, other than that necessary to register, and authenticate you and your services, to respond to any and all requests and supply access to your communications data, nor does it possess access to your encryption private key, and therefore cannot supply a back-door to your data.
Unlike client-server architecture cloud services that store your data and private encryption keys in central repositories, you store your data local first. Unlike public blockchains that permanently record every event, you are in control of saving or deleting your data, as it was in the personal computer era.
Strong Universal Authentication
Notwithstanding the foregoing, MobyNet does require users of to be universally strongly identified. Registering and authenticating yourself, your primary email addresses, phone number, and the Know Your Customer “KYC” information that is required for financial transactions are included in your onboarding. MobyNet does collect your personal information “PI”, during the onboarding processes to authenticate you for the safety of all using MobyNet protocols and applications.
Collection and Use of Personal Information
Personal information is data that can be used to uniquely identify or contact a single person (“PI”).
MobyNet’s philosophy, its decentralized architecture, and approach to its Software are such that MobyNetTM emphasizes your self-sovereign control, ownership, and stewardship of your personal profile, messages, network, and file data. As such, MobyNet endeavors to better respect your privacy than services that centrally store your email messages and data and restrict the portability of your profile and related online data.
You may be asked to provide your personal information anytime you are in contact with MobyNet. Please note that we will never collect the information set forth in this Section “Collection and Use of Personal Information” without your knowledge. You will always know when PI is being requested and collected, whether by completing a fill-in form on the Site, registration of your MobyNet and the MobyMailTM application suite of software products, strong authentication and credential-related services, and endpoint artificial intelligence “StarbuckAITM” solutions, or otherwise. If you do not wish to share the PI requested, you are not required to do so; however, you will not be able to access the applicable Services offering(s) if you do not.
Here are some examples of the types of PI MobyNet may collect and how we may use it.
What personal information we collect
(a) When you create a MobyNet ID, MobyNet MobyMail email address or MobyChat user name, register your MobyNet Software or your domain name for domain name custom business email service, mint a credential on a public blockchain purchase a product, service, or subscription from MobyNet, download a software update, register to be an application developer or content distributor, register for a class from MobyNet, or participate in an online survey we provide we may collect a variety of PI, including your name, mailing address, phone number, email address, contact preferences, Know Your Customer “KYC” and credit card information.
(b) When you order premium content, purchase a MobyNet software license or request access to or use of other software or services for which we charge fees, we will collect payment information, including, as applicable, payment card or other payment account data.
(c) When you share your content with family and friends using the Software or services, send invites to enjoy the Software or services, or invite others to join you on MobyNet forums, MobyNet may collect the PI you provide about those people such as name, mailing address, email address, and phone number.
At MobyNet, we believe that you can have great products and great privacy. This means that we strive to collect only the personal data that we need. The personal data MobyNet collects depends on how you interact with MobyNet. When you create an MobyNet and MobyMail App Suite Account, apply for commercial MobyWorks subscriptions, a MobyNet Enterprise account, download a software update, connect to our services, mint a credential, contact us (including by social media), participate in an online survey, or otherwise interact with MobyNet, we may collect a variety of information, including:

Account Information. Your MobyNet Account and related account details, including email address, phone number, your decentralized-ID, devices registered, account status, and

Device type Information such as PC, MAC, Linus, IOS, or Android. Data from which your device could be identified, such as device serial number, or about your device, such as Contact Information. Data such as name, email address, physical address, phone number, or other contact information

Payment Information. Data about your billing address and method of payment, such as bank details, credit, debit, or other payment card information and will only be shared with a 3rd party merchant to process the payment for subscription or software licenses or any other MobyNet related product, software or services such as decentralized storage.

Transaction Information. Data about purchases of MobyNet products and services or transactions facilitated by MobyNet, including purchases on MobyNet platforms

Fraud Prevention Information. Data used to help identify and prevent fraud, including a device trust score

Usage Data. Data about your activity on and use of our offerings, such as app launches within our services, including browsing history; search history; product interaction; crash data, performance and other diagnostic data; and other usage data

Location Information. Precise location only to support services such as Find My or where you agree for region-specific services, and coarse location

Health Information. Data relating to the health status of an individual, including data related to one’s physical or mental health or condition. Personal health data also includes data that can be used to make inferences about or detect the health status of an individual. If you participate in a study using a MobyNet Health Research Study app, the policy governing the privacy of your personal data is described in the MobyNet Health Study Apps Privacy Policy.

Fitness Information. Details relating to your fitness and exercise information where you choose to share them

Financial Information. Details including salary, income, and assets information where collected, and information related to MobyNet-branded financial offerings

Government ID Data. In certain jurisdictions, we may ask for a government-issued ID in limited circumstances, including when setting up a wireless account and activating your device, for the purpose of extending commercial credit, managing reservations, or as required by law

Other Information You Provide to Us. Details such as the content of your communications with MobyNet, including interactions with customer support and contacts through social media channels

You are not required to provide the personal data that we have requested. However, if you choose not to do so, in many cases we will not be able to provide you with our products or services or respond to requests you may have.
Personal Data MobyNet Receives from Other Sources
MobyNet may receive personal data about you from other individuals, from businesses or third parties acting at your direction, from our partners who work with us to provide our products and services and assist us in security and fraud prevention, and from other lawful sources.

Individuals. MobyNet may collect data about you from other individuals — for example, if that individual has sent you a product or gift card, invited you to participate in an MobyNet service or forum, or shared content with you.

At Your Direction. You may direct other individuals or third parties to share data with MobyNet. For example, you may direct your mobile carrier to share data about your carrier account with MobyNet for account activation, or for your loyalty program to share information about your participation so that you can earn rewards for MobyNet purchases.

MobyNet Partners. We may also validate the information you provide — for example, when creating an MobyNet Account, with a third party for security, and for fraud-prevention purposes.

For research and development purposes, we may use datasets such as those that contain images, voices, or other data that could be associated with an identifiable person. When acquiring such datasets, we do so in accordance with applicable law, including law in the jurisdiction in which the dataset is hosted. When using such datasets for research and development, we do not attempt to reidentify individuals who may appear therein.
What Is Personal Data at MobyNet?
At MobyNet, we believe strongly in fundamental privacy rights — and that those fundamental rights should not differ depending on where you live in the world. That’s why we treat any data that relates to an identified or identifiable individual or that is linked or linkable to them by MobyNet as “personal data,” no matter where the individual lives. This means that data that directly identifies you — such as your name — is personal data, and also data that does not directly identify you, but that can reasonably be used to identify you — such as the serial number of your device — is personal data. Aggregated data is considered non-personal data for the purposes of this Privacy Policy.
This Privacy Policy covers how MobyNet or an MobyNet-affiliated company (collectively, “MobyNet”) handles personal data whether you interact with us on our websites, through MobyNet or third-party apps (such as MobyMail, MobyChatTM, or a Moby NarWalletTM), or in person (including by phone or when visiting any MobyNet Store). MobyNet may also link to third parties on our services or make third-party apps available for download from our website. MobyNetʼs Privacy Policy does not apply to how third parties define personal data or how they use it. We encourage you to read their privacy policies and know your privacy rights before interacting with them.
Your Privacy Rights at MobyNet
At MobyNet, we respect your ability to know, access, correct, transfer, restrict the processing of, and delete your personal data. We have provided these rights to our global customer base and if you choose to exercise these privacy rights, you have the right not to be treated in a discriminatory way nor to receive a lesser degree of service from MobyNet.
Where you are requested to consent to the processing of your personal data to strongly authenticate, you for example, by MobyNet, you have the right to withdraw your consent at any time and uninstall the software, but to use the MobyNet and Moby applications, authentication is aa universal requirement for the safety of all on the network, and to finally reduce the scourge of SPAM and Phishing, which are among the most pervasive cybersecurity risks in email, chat, and social networking applications.

To help protect the security of your personal data, you must sign in to your account and your identity will be verified. You also have the right to lodge a complaint with the applicable regulator.
There may be situations where we cannot grant your request — for example, if you ask us to delete your transaction data and MobyNet is legally obligated to keep a record of that transaction to comply with law. We may also decline to grant a request where doing so would undermine our legitimate use of data for anti-fraud and security purposes, such as when you request deletion of an account that is being investigated for security concerns. Other reasons your privacy request may be denied are if it jeopardizes the privacy of others, is frivolous or vexatious, or would be extremely impractical or unreasonable.

How we use your PI
Our primary purpose in collecting information is to provide you with a safe, smooth, efficient, and customized experience. MobyNet collects and uses your PI relating to you, as permitted or necessary to:

Provide Software and services, in particular to convey the communications you and others make by means of the MobyNet MobyMail software and/or other MobyNet software and services including the Site.

Take, process, or deliver orders made via the Site or affiliated websites, invoice you, or notify you of the status of your order;

Provide other services for you (which will be described when we collect the information), including the sharing of your private keys with your employer if you are part of a subscribing business customer that by necessity requires accessible back-ups of all employee communications.

Customize, measure, and improve the MobyNet Software and services, including, improving our search functionality and helping you find your files and directly update contacts more easily, directly and safely connect and communicate any size file or folder quickly.

Conduct internal audits, data analyses, and research about your and other users’ use of the MobyNet Services;

Organize and carry out MobyNet’s marketing, advertising, or promotional operations/offers, contests, games, and similar events; and

Protect your and MobyNet’s interests, including to enforce our End User License Agreement, Terms of Service, and fight against fraud, phishing, and spam, (together).
We don’t want to send you communications that you don’t want to receive, so you will be able to opt-out of receiving certain promotional, advertising, and marketing communications anytime by updating your preferences on the Site or by opting-out of any opt-in free advertising supported software and by opting-out of any additional subscription or information service provided by third parties.
However, as you see from the list above, from time to time, we may use your personal information to send important notices, such as communications about purchases you have made and changes to our terms, conditions, and policies (including this Policy). Because this information is important to your business relationship with MobyNet, you may not opt-out of receiving these communications.
MobyNetʼs Use of Personal Data
MobyNet uses personal data to register and power our Software and Services, to process your transactions, to communicate with you, for security and fraud prevention, and to comply with law. We may also use personal data for other purposes with your consent.
MobyNet uses your personal data only when we have a valid legal basis to do so. Depending on the circumstance, MobyNet may rely on your consent or the fact that the processing is necessary to fulfill a contract with you, protect your vital interests or those of other persons, or to comply with law. We may also process your personal data where we believe it is in our or others’ legitimate interests, taking into consideration your interests, rights, and expectations. Power Our Services. MobyNet collects personal data necessary to power our services, which may include personal data collected to improve our offerings, for internal purposes such as auditing or data analysis, or for troubleshooting.

To respond to communications, reach out to you about your transactions or account, market our products and services, provide other relevant information, or request information or feedback. To protect individuals, employees, and MobyNet and for loss prevention and to prevent fraud, including to protect individuals, employees, and MobyNet for the benefit of all our users, and prescreening or scanning uploaded content for potentially illegal content, including child sexual exploitation material.

If you choose to personalize your services or communications where such options are available, MobyNet will use information that we collect so that we can offer you those personalized services or communications. Comply with Law. To comply with applicable law — for example, to satisfy tax or reporting obligations, or to comply with a lawful governmental request.
MobyNet does not use algorithms or profiling to make any decision that would significantly affect you without the opportunity for human review. MobyNet also does not use or disclose sensitive personal data for any purposes that would require a user to exercise a right to limit processing according to California law.
MobyNet retains personal data only for so long as necessary to fulfill the purposes for which it was collected, including as described in this Privacy Policy or in our service-specific privacy notices, or as required by law. We will retain your personal data for the period necessary to fulfill the purposes outlined in this Privacy Policy and our service-specific privacy notices. When assessing retention periods, we first carefully examine whether it is necessary to retain the personal data collected and, if retention is required, work to retain the personal data for the shortest possible period permissible under law.
MobyNetʼs Sharing of Personal Data
MobyNet may share personal data with MobyNet-affiliated companies, service providers who act on our behalf, our partners, developers, and publishers, or others at your direction. Further, MobyNet does not share personal data with third parties for their own marketing purposes.
Service Providers. MobyNet may engage third parties to act as our service providers and perform certain tasks on our behalf, such as processing or storing data, including personal data, in connection with your use of our services and delivering products to customers. MobyNet service providers are obligated to handle personal data consistent with this Privacy Policy and according to our instructions. They cannot use the personal data we share for their own purposes and must delete or return the personal data once they’ve fulfilled our request.
Partners. At times, MobyNet may partner with third parties to provide services or other offerings. For example, MobyNet financial offerings like MobyNet Card and MobyNet Cash are offered by MobyNet and our partners. MobyNet requires its partners to protect your personal data.
Developers and Publishers from Whom You Get a Subscription. If you purchase a third-party subscription from our store/marketplace or within MobyNet Newsletter, we create a Subscriber ID that is unique to you and the developer or publisher. The Subscriber ID may be used to provide reports to the developer or publisher, which include information about the subscription you purchased and your country of residence. If you cancel all of your subscriptions from a particular developer or publisher, the Subscriber ID will reset after 180 days if you do not resubscribe. This information is provided to developers or publishers so that they can understand the performance of their subscriptions.
Others. MobyNet may share personal data with others at your direction or with your consent, such as when we share information with your carrier to activate your account. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose information about you where there is a lawful basis for doing so, if we determine that disclosure is reasonably necessary to enforce our terms and conditions or to protect our operations or users, or in the event of a reorganization, merger, or sale.
MobyNet does not sell your personal data including as “sale” is defined in Nevada and California. MobyNet also does not “share” your personal data as that term is defined in California.
Our Affiliates
We may share your PI with our affiliated companies (e.g. parent companies, subsidiaries, sister companies). All our affiliates will be required to adhere to the terms of this Policy.
Our Third -Party Service Providers, Suppliers, Partners, and Vendors
At times MobyNet may make certain personal information available to strategic partners that work with MobyNet to provide products and services, or that help MobyNet market to customers. MobyNet may share PI with unaffiliated companies, such as our strategic partners, suppliers, vendors, and service providers. PI will only be shared by MobyNet to provide or improve our Software or services and direct opt-in brand advertising; it will not be shared with these third-parties for their own marketing purposes. These companies may provide services such as information processing, credit card processing for fulfilling customer orders, delivering products or services to you, managing and enhancing customer data, providing customer service, assessing your interest in our products and services, and conducting customer research or satisfaction surveys.
Others, as required by law or in certain other circumstances
We may disclose your PI under the following circumstances:
(a) If required by law, legal process, litigation, and/or requests from public or governmental authorities within or outside your country of residence:
(b) If we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate;
(c) If we determine that disclosure is reasonably necessary to enforce our Site Terms and Conditions, End User License Agreement, or to otherwise protect our operations or users; and,
(d) In the event of a reorganization, merger, or sale of our business, to our successor entity, entities or purchaser(s).
Note that MobyNet’s mission to directly connect the world, simply directly connects you and your devices to others. MobyNet does not store your personal information beyond that required to register and authenticate you. MobyNet software is designed with local first storage of both your communications history data and your private encryption keys under your self-custody and supports private cloud or distributed storage solutions like the InterPlanetary File Service IPFS, and network addressable storage devices. Nor does MobyNet or its reference applications store the meta data of your communications after they are completed, and only has access to the metadata concerning active ongoing communications.
Protection of Personal Data at MobyNet
At MobyNet, we believe that great privacy rests on great security. We use administrative, technical, and physical safeguards to protect your personal data, taking into account the nature of the personal data and the processing, and the threats posed. Your responsibilities for your PI
Please remember that when you use certain MobyNet Software or services, in particular, if you post on the MobyNet forum(s), in the MobyNet chat room(s), or via a MobyNet social networking software solution, the PI you share is visible to other users and can be read, collected, or used by them. You are responsible for the PI you choose to submit in these instances. For example, if you list your name and email address in a forum posting, that information is public. Please take care when using these features. Finally, please remember that you are also responsible, in addition to MobyNet, for the security and confidentiality of any user name and password that you create or that is assigned to you for access or use of the Services. MobyNet is not responsible for your failure to maintain the security and confidentiality of this information.
Collection and Use of Other Types of Information
MobyNet may also gather and use the following types of non-personal information about you. This information is not considered PI unless it is connected to your name or other PI; therefore, we may collect, use, store and disclose all non-personal information for any reason or purpose. However, if the information is stored, maintained, or in any way connected to any of your PI, we will treat it as PI for as long as it is so stored, maintained, or connected.
Information about you and about other people:
(a) Your non-personal user profile information (e.g. age, gender, country, state, and city of residence, zip code, and any information that you choose to make available to others as part of your MobyNet user profile);
(b) Survey results;
(c) Products or services ordered and delivered, and the cumulative volume of data transferred without knowledge of what was transferred (bytes moved), and the network and sub network topology;
(d) The URL of links such as videos that you have selected to publicly share;
(e) List of your contacts;
(f) Your username and password for other email accounts where you have provided this to us and requested us to search for your friends on MobyNet (please note that MobyNet does not retain this information beyond the time necessary to provide the Service you request or use it for any other purpose);
(g) Correspondence between you and MobyNet;
(h) Content of other third-party communications services that may be integrated in your MobyNet Services experience including phone or video calling, chat, or instant messaging communications.
Information about your computer or other device you use to access and use the Services
Information such as zip code, area code, unique device identifier, location, and the time zone where MobyNet Software or services are used so that we can better understand customer behavior and improve our products, services, and advertising.
Information regarding customer’s devices’ capabilities including OS, storage capacity, and capabilities, activities on our website, Site traffic statistics, mobile services and application stores, and from our other Services. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our Services are of most interest.
Information about your device’s usage of and interaction with the MobyNet Software applications, our Services, the Site, and other MobyNet websites, including computer and connection information, device capability, bandwidth, statistics on page views, and traffic to and from our websites;
However, as indicated above, if we do combine non-personal information with PI, the combined information will be treated as PI for as long as it remains combined.
Cookies and Other Technologies
Some of the information mentioned in this Section is collected by our use of “cookies” and other technologies such as pixel tags and web beacons, including in any advertisements we provide or display to you, particularly on our Site. These technologies help us better understand user behavior, tell us which parts of our website people have visited, and facilitate and measure the effectiveness of advertisements and web searches. We treat information collected by cookies and other technologies as non-personal information. However, to the extent that Internet Protocol (IP) addresses or similar identifiers are considered personal information by local law, we also treat these identifiers as personal information.
In our MobyMail application suite software offering, and in any successor products, MobyNet and its affiliates or our third-party suppliers, service providers, vendors, and partners may use cookies and other technologies in desktop, smart TV, laptop, smartphone, video, social network information and connectivity, and mobile advertising services to control the number of times you see a given ad, deliver ads that relate to your opt-in interests, and measure the effectiveness of ad campaigns. If you do not want to receive ads with this level of relevance you can opt-out partially, or opt-out entirely by purchasing an ad-free license to the applicable Service. If you opt-out partially, you will continue to receive the same number of ads, but they may be less relevant because they will not be based on your interests. You may still see ads related to the content on a web page or in an application or based on other non-personal information. This opt-out applies only to MobyNet advertising services and does not affect interest-based advertising from other advertising networks.
MobyNet also uses cookies and other technologies to remember personal information when you use our Services, including on our Site. Our goal in these cases is to make your experience with MobyNet more convenient and personal. For example, knowing your first name lets us welcome you the next time you access MobyNet Software or Services or visit the Site, where appropriate.
Knowing your country and language − and if you are an educator, your school − helps us provide a customized and more useful experience. Knowing someone using your computer or device has shopped for a certain product or used a particular service helps us make our advertising and email communications more relevant to your interests. Knowing your contact information, product ID, subscription selections, Services mix, and information about your computer or device helps us personalize your experience to make it more user enjoyable, friendly, and productive, and provide you with better customer service.
As is true of most websites and Services, we gather some information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), router data, referring and exit pages, operating system, date/time stamp, and clickstream data. We use this information to directly network you to others, understand and analyze trends, to administer the Site and Services, to learn about user behavior on the site, and to gather demographic information about our user base as a whole. MobyNet may use this information in our marketing and advertising services, but it is always in aggregate and not connected with any PI.
In some of our email messages, and software, we use a “click-through URL” linked to content on the MobyNet website. When customers click one of these URLs, they pass through a separate web server before arriving at the destination page on our website. We may track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages.
Pixel tags enable us or marketers to send email messages in a format customers can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers.
Location-Based Services
To provide location-based services, MobyNet may collect, use, and share (as permitted by this Policy) precise location data, including the real-time geographic location of your computer or device. This location data is collected anonymously in a form that does not personally identify you and is used by all parties who have access to it to provide and improve location-based products and services. For example, we may share geographic location with application providers when you opt-in to their location services.
Some location-based services which may be offered by MobyNet, or MobyNet partners, may require your PI for the feature to work. If you do not wish to share your PI, please do not use, access, or attempt to use or access these location-based services.
Protection of PI
Using the Internet, including our Services, carries inherent risk. We do not guarantee you or your PI will be completely safe. However, we do take precautions — including administrative, technical, and physical measures — to help us protect your PI against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction.
MobyNet online Services use Secure Sockets Layer (SSL) encryption on all Site pages where financial information is collected, and encrypts all communications using MobyNet Software in motion and at rest using TLS and Noise encryption. The Company plans to advance its encryption solutions to post-quantum solutions as they become available but has not deployed quantum computer resistant encryption yet. To make purchases from transactional areas of the Site(s), you must use an SSL-enabled browser such as Chrome, Safari, Firefox, or Internet Explorer, or a secure digital wallet. Doing so helps to protect the confidentiality of your PI while it’s transmitted over the Internet.
Integrity and Retention of Personal Information
MobyNet makes it easy for you to keep your PI accurate, complete, and up to date dynamically as part of our universal strong authentication ethos applied to all MobyNet users in the interest of a safe and secure experience for all. We endeavor to be as transparent as possible so that you may correct and refine your PI as you deem appropriate. We will retain your PI for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law.
Access to Personal Information
You can help ensure that your contact information and preferences are accurate, complete, and up to date by logging in to your account and keeping your information current. For other PI, we make good faith efforts to provide you with access so you can request that we correct the data if it is inaccurate or delete the data if MobyNet is not required to retain it by law or for legitimate business purposes. When you have shared your PI with another user such as a friend or colleague, we may update the information you have shared with them so that it reflects changes you may make to your PI. We may decline to process requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. Access, correction, or deletion requests can be made to the MobyNet privacy email address.
Children - Notice for Minors
MobyNet offers interactive services that may allow you to post content to share publicly or with friends. At any time, you can delete or remove content you have posted by using the deletion or removal options within any of our services. If you have questions about how to remove content in a specific service or if you would like additional assistance with deletion, you can contact our MobyNet Support team directly at support@mobynet.io. Although we offer deletion capability for our services, the removal of content may not ensure complete or comprehensive removal of that content or information posted through the services.
We do not knowingly collect PI from children under 13. If we learn that we have collected the PI of a child under13 we will take steps to delete the information as soon as possible.
We recognize the privacy interests of children and we encourage parents and guardians to take an active role in their children's online activities and interests. The MobyNet Services are not intended for children under the age of 13. We do not target MobyNet or our Services to children under 13. We do not knowingly collect personally identifiable information from children under the age of 13. IF YOU ARE UNDER 13 YEARS OF AGE, PLEASE DO NOT USE THE MOBYNETY SERCIVES OR ACCESS THE SITE AT ANY TIME OR IN ANY MANNER. MobyNet does not track its customers over time and across third-party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals.
